HUBBLE HABITS — TERMS & CONDITIONS

1. ACCEPTANCE OF TERMS

By downloading, installing, or using Hubble Habits ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App. We reserve the right to update these Terms at any time, and your continued use of the App after changes constitutes acceptance of the revised Terms.

2. DESCRIPTION OF SERVICE

Hubble Habits is a gamified habit-tracking application that allows users to create and track daily habits, earn experience points (XP), level up, evolve virtual characters, view analytics, and participate in social features including leaderboards and friend interactions. The App may also provide AI-powered habit productivity assessments.

3. ELIGIBILITY

You must be at least 13 years of age to use the App. By creating an account, you represent and warrant that you are at least 13 years old. If you are under the age of 18, you must have the consent of a parent or legal guardian to use the App.

4. ACCOUNT REGISTRATION & SECURITY

- You must provide accurate and complete information when creating an account, including a valid email address and username.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorised use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.

5. USER CONDUCT

When using the App, you agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws.
- Harass, abuse, threaten, or intimidate other users.
- Create offensive, misleading, or inappropriate usernames.
- Attempt to gain unauthorised access to other user accounts, the App's systems, or data.
- Use automated scripts, bots, or other means to manipulate the App, leaderboard rankings, or XP system.
- Reverse-engineer, decompile, or disassemble any part of the App.
- Exploit bugs or vulnerabilities rather than reporting them.

There is no tolerance for objectionable content or abusive behaviour. You can report any user from the friends list or the leaderboard, and block them so you no longer appear to each other. We review every report and remove offending content and accounts, typically within 24 hours.

We reserve the right to suspend or permanently terminate accounts that engage in prohibited conduct, at our sole discretion.

6. SUBSCRIPTIONS & PAYMENTS

6.1 Free Tier
The App offers a free tier with core habit-tracking features. Free users may have limits on certain features, such as the number of AI habit assessments per period, and see advertising.

6.2 Premium Subscription
- Premium features are available through an in-app subscription ("Premium").
- Subscription prices are displayed in the App and may vary by region.
- Payment is charged to your Apple Account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.
- You can manage and cancel subscriptions in your device's Settings > Apple Account > Subscriptions.
- Deleting your Hubble Habits account does not cancel an active subscription. Subscriptions are billed by Apple and must be cancelled separately.

6.3 Refunds
All purchases are processed through Apple's App Store. Refund requests must be directed to Apple in accordance with their refund policies. We do not process refunds directly.

7. INTELLECTUAL PROPERTY

- The App, including its design, graphics, characters, animations, text, and code, is owned by Hubble Habits and protected by intellectual property laws.
- You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes.
- You may not copy, modify, distribute, sell, or create derivative works based on the App or its content without our prior written consent.
- All trademarks, service marks, and trade names used in the App are the property of their respective owners.

8. AI-POWERED FEATURES

The App may use artificial intelligence to assess habit productivity. AI assessments are provided for informational and motivational purposes only and should not be considered professional, medical, or psychological advice. Results may vary and are not guaranteed to be accurate. We are not liable for any actions taken based on AI-generated recommendations.

9. SOCIAL FEATURES & LEADERBOARD

- The App offers social features including friend requests, a friends list, and leaderboards.
- Participation in the global leaderboard is optional and can be toggled in Settings.
- If you opt in, your username, level, XP, and character will be visible to other users.
- Usernames are screened automatically for offensive language when you create or change them.
- You can report or block any user from the friends list or the leaderboard. Blocking is mutual: neither of you will see the other in search or on leaderboards, and any friendship between you is removed. Blocked users can be unblocked from Settings.
- We reserve the right to remove users from the leaderboard for violations of these Terms.

10. PRIVACY

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

11. DISCLAIMERS

- The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied.
- We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
- We make no guarantees regarding the accuracy of AI-generated habit assessments or analytics.
- Hubble Habits is not a medical, psychological, or therapeutic service. If you have health concerns, consult a qualified professional.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Hubble Habits and its developers, officers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to loss of data, loss of profits, or damages resulting from reliance on AI-generated content. Our total liability shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.

13. TERMINATION

- You may stop using the App and delete your account at any time from Settings > Delete Account.
- We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice.
- Upon termination, your licence to use the App ceases and we may delete your data, subject to any legal retention requirements.
- Sections on Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law survive termination.

14. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Hubble Habits operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or the competent courts of the governing jurisdiction.

15. CHANGES TO THESE TERMS

We may revise these Terms at any time by posting the updated version within the App. Material changes will be communicated through the App or via email. The "Last updated" date at the top reflects the most recent revision. Your continued use of the App after any changes constitutes your acceptance of the new Terms.
